paid vacation allows employees to rest and devote time to personal needs and interests. In this and the following article, we will consider in more detail the legal provisions governing this right, including the duration, method of use and compensation for the time spent on vacation.
The right to annual leave
Law on vacation have persons who are in employment. It follows that this right is not exercised by persons who are engaged without establishing an employment relationship (work contract, contract on temporary and occasional jobs, etc.).
Duration of vacation
- · The worker, for each calendar year, has the right to a paid vacation for the duration of at least 20 working days, and at most 30 working days.
- · This the employee acquires the right on 01.01. for that calendar year as a result of which there is no possibility of a proportional reduction of annual leave for an employee whose employment relationship ends during the year.
- · A worker who is employed for the first time or who has a break between two employment relationships of more than 15 days, the right to annual leave is acquired only after six months of continuous work. In these circumstances, the worker has the right to at least one day of annual leave for each completed month of work, in accordance with the collective agreement, the work regulations and the work contract.
- · Absence from work due to temporary incapacity for work, maternity and other leave that is not determined by the will of the employee is not considered as termination of employment.
- · The duration of annual leave longer than the shortest prescribed by this Law shall be regulated by a collective agreement, work regulations or employment contract. Since the Law does not define the criteria for increase in the duration of annual leave, they are defined by the employer, if he so decides.
- · It is not included in the duration of annual leave time of temporary incapacity for work, holiday time during which no work is done, as well as other time of absence from work that is recognized for the employee's insurance record. If the above-mentioned circumstances occur during the use of the employee's annual leave, it is interrupted and after the end of the above-mentioned circumstances, the employee continues to use the annual leave.
Special categories
Workers who work part-time they have the right to a full annual vacation because the right to it is linked to the fact that the person is in an employment relationship and not to the fact of working hours.
Workers who work for a fixed period of time they have the right to vacation that they earned during the duration of the employment relationship or during that calendar year.
Legal provisions regarding annual leave do not apply to directors so the right and method of use is prescribed by the contract.
